On 17th May 2020, The administration in the Union Territory (UT) of Jammu and Kashmir issued a new set of rules named “Jammu and Kashmir Grant of Domicile Certificate Rules 2020” which defines the rules for issuing domicile certificates in the UT.
Key Points:
i.The Jammu and Kashmir Grant of Domicile Certificate Rules 2020” will define the basis for issuing domicile certificates to the people who satisfies the conditions stated in the Centre’s gazette notification introduced the domicile clause through an amendment to the J&K Civil Services (Decentralisation and Recruitment) Act,2010.
ii.These rules will provide a time-bound and transparent procedure in the issuing of domicile certificates.
iii.The Deputy Commissioner, Relief and Rehabilitation Commissioner, Financial Commissioner Revenue or Secretary GAD will direct the tehsildars to issue the certificate within 7 days if the application is processed within 15 days and the officers will be penalised Rs. 50,000 if failed to provide the domicile certificate.
Overview of “Jammu and Kashmir Grant of Domicile Certificate Rules 2020”:
i.This amended rule allows the eligible non-local and all permanent resident certificate holders and their children living outside J&K to apply for the certificates.
ii.Kashmiri migrants living inside or outside the J&K can get the certificate by producing their permanent residence certificate (PRC), ration card copy, voter card or other valid documents.
iii.The Bonafide migrants can apply for the certificate with the Relief and Rehabilitation department with their document like electoral rolls of 1988, proof of registration as migrant in any state or other documents.
iv.The West Pakistan Refugees and Children of the women married outside J&K and Safai Karamcharis are eligible to apply for the domicile status.
v.The certificate is made a basic eligibility condition for appointment to any post under the Union Territory of J&K following the amendments.
Background:
The Jammu and Kashmir Reorganization (Adaptation of States Laws) order 2020 of Government of India defines a domicile person as an individual resided in the UT of J&K for over a period of 15 years or studied in the UT for a period of 15 years and appeared in class 10 or 12 examinations in any J&K educational institute
