On May 8, 2020 The Uttar Pradesh(UP) government has passed an ordinance ‘Uttar Pradesh Temporary Exemption from Certain Labour Laws Ordinance, 2020’, to suspend most of the labour laws for 3 years, where all factories & manufacturing establishments will be exempt from existing labour laws except few.Gist about the ordinance
i.Aim– To encourage industries to employ the large number of migrant workers that have come back & new investments to set up new industrial infrastructure and to benefit the existing industries & factories
ii.Purpose– There is a slow industrial activity(state) & the state needs to revive the economy back on track due the COVID-19 pandemic outbreak.
iii.The ordinance has come in with certain safeguards regarding minimum wages, health and safety of the workers, if anyone is found misusing it then action will be taken against the unit in the suitable forum.
iv.The ordinance has been sent to Governor Anandiben Mafatbhai Patel for approval.
Exempted labour laws in the ordinance
i.Bonded Labour System (Abolition) Act, 1976
ii.Employee Compensation Act, 1923- When the employee suffers from any physical impairment or illness during employment in hazardous working conditions, the employer has a legal obligation to discharge his moral obligation towards employees
iii.Building and Other Construction Workers Act, 1996- safety, health and welfare measures
iv.Section 5 of Payment of Wages Act, 1936- ensure timely payment of daily wages
v.The provisions related to women and children.
