Justice Department launches “Enforcing Contracts Portal”

On 28th June 2021, Barun Mitra, Secretary at Department of Justice launched the “Enforcing Contracts Portal” that is aimed at improving the Ease of Doing Business (EoDB) in India.

The Department of Justice under the Ministry of Law and Justice, is the nodal agency responsible for all policy reforms on “Enforcing Contracts” for improving the EoDB in India.

Features of Portal:

i.Provides up to date information on all commercial cases in Dedicated Commercial Courts in Delhi, Mumbai, Bengaluru and Kolkata.

ii.Online reporting by all High Courts regarding the Mediation & Arbitration centres annexed to the Commercial Courts in order to maintain Pre-Institution Mediation and Settlement(PIMS) of commercial cases

iii.Provides instructive videos & manuals for e-filing, and use of other useful apps – eCourt services app, JustIS app

Why is Contract Enforcement Important?

  • Enforcing Contract, is a method used for standardized commercial dispute resolution
  • Contract Enforcement is one of the 11 areas of business regulations used in the World Bank’s EoDB ranking

Note – India was ranked 63rd in the World Bank’s Ease of Doing Business 2020 index.

Currently, only the cities of Delhi and Mumbai are under the purview of the Ease of Doing Business survey by World Bank. Kolkata and Bengaluru are likely to be included in the Doing Business Report in future.
