Decriminalisation of Section 377

Section 377 of IPC states that whoever, voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine or in simple words any form of unnatural sex such as homosexuality etc. is criminalized in India. Lacking precise definition, Section 377 became subject to varied judicial interpretation over the years. This section states “with any man, woman or animal”, it means this section punishes homosexuality and bestiality as a whole because according to this section these are unnatural forms of intercourse which is not procreative. Section 377 ban acts of homosexuality as well as some act of heterosexuality which are not natural like anal or oral sex.

The Supreme court has delivered a verdict on September 6th , 2018 unanimously decriminalising section 377 of Indian Penal Code.Decriminalization of 377 is just the beginning and much has to be done in changing the mindsets of people and making them aware that there are individuals whose identities differ from those embraced in today’s mainstream society and that everyone deserves equal respect, regardless of their orientation. In our country, it is considered a mental illness and a few self-proclaimed spirituality and wellness gurus even go as far as claiming to be able to cure it.

Basically homosexuality is a private act and it is executed in a very confidential manner between two consenting adults. The reason behind this is very obvious, section 377 of the Indian Penal Code and social unacceptability. Because this law results into social stigma upon the homosexuals, in order to skip this act is being done in hiding, is clearly the abuse of law. And now with the applauding judgement by the Apex court , it is clear that this is no more a social stigma and every individual has his personal choice to live the way they want. It is a concept that is widely accepted throughout the world and it is time India moved ahead with embracing progressive laws to join other nations on the path of development and progress.

To conclude it can be said that coming out of the closet may not be easy. Interfaith relationships were never a criminal offence, yet have severe repercussions and something like same-sex relationships will take a long time to lose the stigma attached. Decriminalization is the first progressive step in acknowledging and normalizing the rights of those forced into secrecy and attempting to dictate gender boundaries for love could only be done by changing the thinking of people. Insulting someone on the basis of their orientation is a violation of human rights, as everyone is entitled to a dignified life.
