NITI Aayog Released a Draft Model Act and Rules for States on Conclusive Land Titling

Niti Aayog releases draft model Act on land titlesOn October 30, 2020 NITI (National Institution for Transforming India) Aayog released a draft model Act and rules for states on conclusive land titling. It was released to minimise litigation and ease the land acquisition process for infrastructure projects.

Gist about Model Act and Rules for States on Conclusive Land Titling:

i.The model act and rules enables state governments to establish, administer and manage the title registration of immovable properties.

ii.After 3 years of its notification, the register of title ends without any external action.

Person Distressed by an entry in the Record of Titles 

i.As per the Act, if any person is distressed by an entry in the Record of Titles notified under Section 11, may file an objection before the Title Registration Officer within three years from the date of such notification.

ii.After this, the Title Registration Officer shall make an entry in the Register of Titles and in the Register of Disputes and refer the case to the land dispute resolution officer.

iii.An aggrieved party with order of the land dispute resolution officer may file an appeal before the Land Titling Appellate Tribunal within 30 days of passing of such an order.

iv.In order to deal with appeals against the orders passed by the Land Titling Appellate Tribunal, a special bench of the High Court shall be designated. The act provides  a 30-day window to appeal before the High Court.

Note

The state guarantees Conclusive land titles for correctness and entails provision for compensation by the state in case of any dispute.

A Land title is a document that determines the ownership of land or an immovable property.
